Right of Withdrawal

  • Pursuant to Articles 52 et seq. of Legislative Decree no. 21/2014, implemented in accordance with Directive 2011/83/EU on consumer rights, amending Directives 93/13/EEC and 1999/44/EC and repealing Directives 85/577/EEC and 97/7/EC, a "Consumer" Customer is defined as a natural person who concludes a purchase remotely or away from business premises, for purposes not related to his or her professional or entrepreneurial activity, or who makes the purchase without indicating a VAT number on the order form, who has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as established by the Consumer Code in the following Sections 1.4, 1.5 and 1.6.

  • 1. REQUEST METHODS

    To exercise the right of withdrawal, the Customer must send LUCE SRLS (hereinafter www.laltrosolecentroestetico.com ) , via email, certified email, fax or registered letter, an explicit declaration of withdrawal from the contract, no later than 14 days from the date of receipt of the goods by the Customer or a designated third party.

  • 2. RETURN OF GOODS

    Upon receipt of the Customer's communication, " LUCE SRLS " will send the Customer the withdrawal form via email, complete with an authorization number. The form must be attached by the Customer to the outside of the package in which the goods to be returned will be placed. The Customer must then send the goods in their original packaging to " LUCE SRLS "  (at the address indicated on the Return form) within 14 days of receiving the withdrawal form, by post or express courier.

  • 3. MANDATORY CONDITIONS

    The right of withdrawal is subject to the following mandatory conditions:

    3.1. The right of withdrawal applies to the product purchased in its entirety; it is not possible to exercise the right of withdrawal on only part of the purchased product;

    3.2. The purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories). To limit damage to the original packaging, we recommend placing it, whenever possible, in a second box, on which the RMA number (Return Merchandise Authorization Code) issued by " LUCE SRLS " must be affixed. Under no circumstances should labels or adhesive tape be placed directly on the product's original packaging.

    3.3. The goods subject to the exercise of the right of withdrawal must be returned without obvious signs of use, other than those compatible with carrying out a normal test of the item.

    3.4. Shipping costs for returning the goods are the responsibility of the Customer; if the Customer requests " LUCE SRLS " to organize the collection of the goods on your behalf, " LUCE SRLS "  will charge the Customer the cost of the service performed, equal to €15.00.

    3.5. the shipment, until the certificate of receipt at the " LUCE SRLS " headquarters, is always under the complete responsibility of the Customer;

    3.6. In the event of damage to the goods during transport, " LUCE SRLS " will notify the Customer of the incident (within 5 working days of receiving the goods at its premises), to allow the Customer to promptly file a complaint with the courier of his choice and obtain a refund for the value of the goods (if insured). In this case, the product will be made available to the Customer for return, with the cancellation of the withdrawal request.

    3.7. " LUCE SRLS "  is not responsible in any way for damage or theft/loss of goods sent for return.

  • 4. EXCLUSIONS

    The right of withdrawal does not apply:

    4.1. for all orders where the amount to be paid by the consumer does not exceed €50.00;

    4.2. for the supply of goods made to measure or clearly personalized;

    4.3. for the supply of goods which are liable to deteriorate or expire rapidly;

    4.4. for the supply of sealed goods which are not suitable for return for hygiene or health protection reasons and have been opened after delivery;

    4.5. for Contracts concluded with Professional customers.

    With reference to Subsections 4.3. and 4.4. of the Consumer Code, listed above, the Customer is informed and accepts that the Products that "risk deteriorating or expiring rapidly" include both all food Products (including wines, spirits and beverages) and cosmetics, as the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage. Therefore, for reasons of hygiene and Customer protection, the right of withdrawal is applicable only for Products purchased on the Site which can be returned to " LUCE SRLS " and put back on the market without posing any risk to the health of consumers (such as books, kitchen utensils, ceramics, small appliances, etc.).

  • 5. REFUND

    In the event of legitimate and regular exercise of the right of withdrawal by the Customer, " LUCE SRLS "  will refund the full amount paid, including shipping costs (with the exception of additional costs resulting from the possible choice of a type of delivery other than the least expensive type of Standard delivery offered by " LUCE SRLS " ), without undue delay and in any case no later than 14 days from the date of receipt of the notice of withdrawal, upon receipt and verification of the goods.

    The refund will be made using the same payment method used for the initial transaction, unless the Customer has expressly agreed otherwise: through the reversal of the amount charged to the Credit Card, or through the reversal of the transaction carried out on PayPal, or by bank transfer.
    In the latter case, it will be the Customer's responsibility to promptly provide the bank details to which the refund will be sent (IBAN code, exact name of the account holder, company name and address of the banking institution).

  • In cases of exclusion of the right of withdrawal or in the event that this is requested without respecting the methods indicated in Sections 1, 2 and 3, LUCE SRLS will return the purchased Products to the Customer, charging the latter the shipping costs.
